All passengers must review and sign this waiver before departure.
1. Acknowledgment of Risk. I understand that participating in boating and water-related activities, including but not limited to wake surfing, tubing, swimming, and operating or riding on watercraft, involves inherent risks of serious injury or death. These risks include but are not limited to drowning, collisions, slips and falls, equipment failure, changing weather conditions, and other hazards.
2. Assumption of Risk. I voluntarily assume full responsibility for all risks of loss, damage, or injury to myself and any minors in my care while participating in activities with ATX Water Rentals, whether on the vessel, in the water, or at the marina.
3. Release and Waiver. I hereby release, waive, discharge, and covenant not to sue ATX Water Rentals, its owners, operators, employees, agents, and affiliates from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury sustained during rental or use of any equipment or vessel.
4. Indemnification. I agree to indemnify and hold harmless ATX Water Rentals and its affiliates from any loss, liability, damage, or costs, including attorney's fees, arising out of or related to my or any minor's participation, whether caused by negligence or otherwise.
5. Compliance with Instructions. I agree to follow all safety instructions provided by the captain or staff, wear provided safety equipment, and obey all applicable laws and regulations.
6. Medical Authorization. In the event of injury, I authorize ATX Water Rentals staff to seek emergency medical treatment on my behalf, and I accept full financial responsibility for any such treatment.
7. Photography Release. I grant ATX Water Rentals permission to use any photographs or video taken during the rental for promotional purposes without compensation.
8. Governing Law. This agreement shall be governed by the laws of the State of Texas. I acknowledge that I have read this agreement, understand it fully, and sign it freely and voluntarily.
9. Minor Acknowledgment (Optional). If signing on behalf of a minor child, I confirm I am the parent or legal guardian of the minor listed below and have the authority to sign on their behalf. I agree that the minor will be bound by all terms of this waiver, and I accept full responsibility for the minor's safety and conduct during the rental.
